Who can change their last name in California?
In California, any adult may petition the court to change their last name. Additionally, a parent may petition the court to change the last name of their minor child – although the parent will be required to give notice to the other parent, if possible and if notice can be reasonably given. Although most names will be acceptable to the Court, the judge hearing your name change petition does have the authority to reject your name change. How long will it take to complete the steps above and get my last name legally changed? Can I skip any of the steps to change my name quicker?
You cannot skip any of the steps, as they are required by California State law (see CCP §1275-1279.6). The length of time it will take to complete the steps required to change your last name will depend on many factors. There are as many as 10 court forms that you will have to complete and submit to the Clerk of the Court, which can take considerable time to complete in full. Then you have to schedule time in your life to go to the court – take time off work, try to go over your lunch hour, etc. You’ll need to block off time to go to your local newspaper office and to request them to print any legally required advertisements of your intended name change. Then you’ll need to wait for the paper to publish your notices. You’ll need to allow time for the court to review your petition and associated forms, and then you’ll need to take time to attend a hearing where you will find out if your name change has been approved.
